NTSB wants to mandate motorcycle helmets in all 50 states

The board has five members, one of whom is designated the chairman by the U.S. President and then approved by the U.S. Senate for a fixed 2-year term. Another member is designated as vice chairman, and becomes acting chairman when there is no formal chairman.

Mark V. Rosenker of Virginia was sworn in as the 11th Chairman of the National Transportation Safety Board on August 11, 2006. He had been serving as Acting Chairman since March 2005. His two-year term as Chairman runs until August 2008. In January 2006, after confirmation by the Senate, he began his second term as a Member, which will expire on December 31, 2010.

Mr. Rosenker's interest and experience in transportation safety dates back more than three decades to his time at a major national public affairs organization. His clients there included the American Safety Belt Council, the Motorcycle Safety Foundation, and the Safety Helmet Council of America. He later served as Director of Communications for the American Moped/Motorized Bicycle Association.


Chairman Rosenker became a Member of the NTSB in March 2003 and was designated by President Bush as Vice Chairman that April.

Beginning January 20, 2001 until the announcement of his nomination to the Board, Mr. Rosenker served as Deputy Assistant to the President and Director of the White House Military Office. In this capacity, he had responsibility for policies, personnel and plans that involve Department of Defense assets in direct support of the President.

THE VICE PRESIDENT: Please, at ease. (Laughter.) Well, thank you very much for the warm welcome. It's good to be here today on a very special occasion.

My duty today is to administer the oath of office to a fine American, and to the President's own choice to lead the National Transportation Safety Board. I know it's a proud moment for Mark and Heather. Mark was, of course, recently confirmed by the U.S. Senate -- and I note that the nomination got through without me having to cast the tie-breaking vote. (Laughter.) It's a good sign, Mark.

The Motorcycle Safety Foundation (MSF) believes that a motorcycle is only as safe as the person operating it.

* A responsible rider knows what his or her skill level is and rides within it.
* He uses his RiderRadar to constantly scan for hazards and plan ahead.
* She slows down to give herself time and space to react whenever on an unfamiliar road.
* He makes sure he and his passenger wear the same protective gear: a DOT helmet, eye protection, jacket, full-fingered gloves, sturdy pants and boots.

Safety Helmet Council of America

A group of motorcycle helmet manufacturers formed an industry organization, the Safety Helmet Council of America (SHCA), to provide a third party certification program to the new DOT standard. The program required manufacturers to submit test data for each new motorcycle helmet model before introducing into the market and to make annual submissions of test results for each model already on the market. Participating manufacturers were allowed to mark their products with an SHCA label. The SHCA collapsed during the 1980's.

When the DOT standard took effect, it was accompanied by a Federal push for State laws requiring motorcyclists to use appropriate headgear. Mandatory use laws were enacted in a number of states but many were repealed a few years later. For a time, NHTSA linked distribution of Federal highway monies to the passage of state helmet laws. This practice has been disallowed.

They are not being fair

why should the Government be allowed to tell people what they have to wear. allowing the Government control in every aspect of our lives, I don't want them having that much control and I know a lot of people will not vote for this to happen period and most of them that don't like bikers is bc theyr not a biker and would probably never own a bike, not all bikers are bad and unsafe, so we should do something with cars and trucks as well to make sure they are seen at all times, bc most cars do not pay attention to what they are doing, at least you never see a dude on a bike going down the road text messaging while driving.
